1. Overview
Unibids L.L.C-FZ operates this E-commerce Auction Store, the Mobile Application, and the Website (combinedly as “Unibids.me”). Throughout the site, the terms “we”, “us”, and “our” refer to Unibids.me. Unibids™ offers this E-commerce Auction Store, the Mobile Application, and the Website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By using Unibids.me and/or purchasing a Product or participating in the Product auction from us, you engage in our “Service” and agree to be bound by the following Terms and Conditions (“Terms and Conditions”, “Terms”), including those additional Terms and Conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of Unibids.me, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms and Conditions carefully before accessing or using Unibids.me. By accessing or using any part of Unibids.me, you agree to be bound by these Terms and Conditions. If you do not agree to all the Terms and Conditions of this agreement, then you may not access Unibids.me or use any of the services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to these Terms and Conditions.
Any new features or tools that are added to the current E-commerce Auction Store shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change, or replace any part of these Terms and Conditions by posting updates and/or changes to Unibids.me. It is your responsibility to check this page periodically for changes. Your continued use of or access to Unibids.me following the posting of any changes constitutes acceptance of those changes.
2. Online Store Terms
2.1 By agreeing to these Terms and Conditions, you represent that you are of 18 years old, or you are at least the age of majority in your country or province of residence, or that you are the age of majority in your country or province of residence to use this site.
2.2 You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
2.3 You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your services.
3. General Terms & Conditions
3.1 We reserve the right to refuse Service to anyone for any reason at any time.
3.2 You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on Unibids.me through which the Service is provided, without express written permission by us.
3.3 This agreement may be available in languages other than English. To the extent of any irregularities or conflicts between these English Terms and Conditions and in another language, the latest English version of this agreement will prevail. Any questions emerging out of these Terms and Conditions will be settled in English unless otherwise determined by Unibids L.L.C-FZ (acting in its sole discretion) or as required by applicable law.
3.4 The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
3.5 These are our “General Terms”, and they apply to the Service that we promote and administer, including, without limitation, online and/or on mobile.
3.6 Each Service may also have its own Specific Terms and Conditions explaining the details of the Service involved with. These “Specific Terms” will, as applicable, be published on our webpage.
3.7 These General Terms shall apply in addition to any Specific Terms that may also be in place for the Service on any platform. You should always read these General Terms together with the Specific Terms. If any Specific Terms conflict with these General Terms, the Specific Terms will prevail.
3.8 These General Terms may be amended at any time without prior notice. We may change these General Terms at any time, so you should check this page regularly for any changes. Changes will apply from the date that they are published on this page. It is your responsibility to ensure you review the current General Terms as well as Specific Terms before using our Service.
3.9 By using the Service, you are accepting that you will be legally bound by these General Terms and the applicable Specific Terms. If you do not agree with any aspect of the General Terms or Specific Terms, then you should not use our Service.
3.10 We recommend that you print and store or save a copy of these Terms and Conditions for future reference.
4. Modifications to the Service, Bids, and Prices
4.1 Bids and Prices for our Products are subject to change without notice.
4.2 We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
4.3 We shall not be liable to you or to any third party for any modification, bid or price change, suspension, or discontinuance of the Service.
5. Products or Services
5.1 Certain Products or Services may be available exclusively online through Unibids.me. These Products or Services may have limited quantities and are subject to return or exchange only according to our Returns & Refund Policy.
5.2 We have made every effort to display as accurately as possible the colours and images of our Products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
5.3 We reserve the right but are not obligated to limit the sales of our Products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any Products or Services that we offer. All descriptions of Products or Product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any Product at any time. Any offer for any Products or Services made on this site is void where prohibited.
5.4 We do not provide the Products or Services to OFAC sanctioned countries.
5.5 We do not warrant that the quality of any Products, Services, information, or other material purchased or obtained by you will meet your expectations or that any errors in the Service will be corrected.
6. Accuracy of Billing and Account Information
6.1 We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel bids won per person or household. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
6.2 You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and phone number, so that we can complete your orders and contact you as needed.
6.3 You agree to retain copies of all transaction records and adhere to this Terms and Conditions.
7. Optional Tools
7.1 You acknowledge and agree that we provide access to any optional tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
7.2 Any use by you of optional tools offered through the site is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
7.3 We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms and Conditions.
8. Third-Party Links
8.1 Certain content, Products, and Services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy, and we do not warrant and will not have any liability or responsibility for any third-party materials or websites or for any other materials, products, or services of third parties.
8.2 We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.
9. User Comments, Feedback, and Other Submissions
9.1 If at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
9.2 We may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s Intellectual Property or these Terms and Conditions.
9.3 You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You further agree that your comments will not contain libelous or otherwise unlawful, abusive, or obscene material or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.
10. Personal Information
Your submission of personal information through Unibids.me is governed by our Privacy Policy. You are responsible for maintaining the confidentiality of your accounts.
11. Errors, Inaccuracies, and Omissions
Occasionally, there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to Product descriptions, pricing, promotions, offers, Product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend, or clarify information in the Service or on any related website, including, without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.
12. Prohibited Uses
In addition to other prohibitions, as set forth in the Terms and Conditions, you are prohibited from using the site or its content:
a) for any unlawful purpose
b) to solicit others to perform or participate in any unlawful acts
c) to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
d) to infringe upon or violate our Intellectual Property Rights or the Intellectual Property Rights of others
e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability
f) to submit false or misleading information
g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet
h) to collect or track the personal information of others
i) to spam, phish, pharm, pretext, spider, crawl, or scrape
j) for any obscene or immoral purpose, or
k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses
13. Intellectual Property
13.1 The Unibids™ logo and Unibids.me are Trademarks or Service marks of Unibids L.L.C-FZ. The Service, including but not limited to its graphics, logos, page headers, button icons, scripts, and Service names, constitutes the Trade dress of Unibids L.L.C-FZ. The Trademarks, Service marks, and Trade dress may not be used or reproduced without prior written approval from us and may not be used in connection with any Product or Service that is not affiliated with us, in any manner that is likely to cause confusion among customers, in any manner that dilutes the rights of us, or in any manner that disparages or discredits us. Other Trademarks that appear on our website and user interfaces are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us. Any images of persons or personalities contained on our website and user interfaces are not an indication or endorsement by us or any particular Product or our Service unless otherwise indicated.
13.2 The Service, including all content included on our user interfaces, or delivered to users as part of the Service, including, but not limited to, source code, data compilations, and software, are the property of us or its licensors and are protected by trade secret or other Intellectual Property laws and treaties. While the Service includes open-source software available for free, the compilation of all content and any software or other materials provided by us, or in connection with the Service is the exclusive property of us and its licensors and is protected by the copyright and trade secret laws in the territories in which the Service operate and by international treaty provisions. Content shall not be reproduced or used without express written permission from us or its licensors. You agree to adhere to the restrictions set forth in these Terms and Conditions.
13.3 You agree not to decompile, reverse engineer, or disassemble any software or other products or processes accessible from us, not to insert any code or product into or manipulate the content of the Service in any way, and not to use any data mining, data gathering, or extraction method. We reserve the right to terminate your membership hereunder if we, in its sole and absolute discretion, believe that you are in violation of our software restrictions, restrictions against copying the Service provided to you by us, or other unauthorized copying or use of our proprietary content in violation of the copyrights of us and its licensors.
13.4 We do not promote, foster, or condone the copying of third-party products or categories or any other infringing activity. While the use of the Service, including demos of E-commerce Auction Stores, store Products, and Services, is for your commercial use, such items proprietary to third parties are not. Please see the instructions at the end of these Terms and Conditions for notifying us of the presence of any allegedly infringing content of the Service, including any on the website Unibids.me.
14. Disclaimer of Warranties; Limitation of Liability
14.1 We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free.
14.2 We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
14.3 You agree that from time to time, we may remove the Service for indefinite periods of time or cancel the Service at any time without notice to you.
14.4 You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all Products and Services delivered to you through the Service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties, or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
14.5 In no case shall we, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any Products procured using the Service, or for any other claim related in any way to your use of the Service or any Product, including, but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or Product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.
14.6 Because some countries or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such countries or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend and hold harmless Unibids™, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference or your violation of any law or the rights of a third party.
16. Severability
In the event that any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
17. Termination
17.1 The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
17.2 These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services or when you cease using our site.
17.3 If in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
18. Entire Agreement
18.1 The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
18.2 These Terms and Conditions and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions).
18.3 Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party.
19. Payment Methods and Authorisations
We accept payments using VISA, MasterCard, UnionPay, and Diner Club cards. Currently, we accept payments in Emirati Dirhams (AED) only.
Orders from Unibids.me will be charged at the time of purchase. When you place an order, we contact your bank for a purchase authorization to verify your payment account, and will be charged.
20. Claims for Property Damage and Personal Injury
20.1 We are not responsible and will not offer to compensate you for medical expenses, lost wages, property damage, non-economic damages, business losses, consequential and incidental damages, attorney fees, punitive damages, or other losses.
20.2 Any claims you make will be subject to the Unibids™ and/or distributor’s/manufacturer’s Conditions of Use, including its choice of law and dispute resolution provisions. In the event of a conflict between Unibids™ and/or the distributor’s/manufacturer’s Conditions of Use and these Terms and Conditions, this Terms and Conditions will govern.
21. Eligibility Rules for Product Auctions
21.1 Participants must meet all eligibility requirements as specified in this Terms and Conditions and/or the Specific Terms. Participants must be residents of the country mentioned for the Product and must be aged 18 years or over at the time of participation unless specified in the Specific Terms or otherwise. Minors under 18 years cannot register and participate in auctions on our website/application. Unibids™ will not deliver any Products to any address outside the country.
21.2 Certain auctions may have additional eligibility requirements such as residential area codes, valid passports, visas, driving licenses, good physical health, etc. All eligibility requirements will be detailed in the applicable Specific Terms.
21.3 Whether any eligibility requirement has or has not been met is always at our sole discretion, and we may require evidence or confirmation from participants before awarding the Products.
21.4 Unibids L.L.C-FZ employees and partners and their immediate families (including any live-in partner) and the employees of any third-party sponsors, Product suppliers, or their immediate families are ineligible to participate in the auction. Any such actions are invalid.
21.5 Use of a false name or address will result in disqualifications.
21.6 Auction participation made online using methods generated by a script, macro, or the use of automated devices will be void.
22. Auctions and Participation Methods
22.1 Product Auctions
22.1.1 Unless otherwise indicated or in accordance with any Specific Terms, auctions for the Products are for subscribed members only. Members are required to follow the instructions on the website/application as indicated in the Specific Terms. Internet service providers’ fees may apply when accessing the internet. By using the Website/Application, members also agree to the Website/Application Terms and Conditions.
22.1.2 You simply need to visit our Website or download and use the Mobile Application and enter by following the on-screen instructions. You will be asked to sign in and then select the ‘Bid to Buy’ or 'Bid & Win' button to participate in the auction and register the bid for the selected Product.
22.1.3 The member can participate in the auction and bid for a Product by using the subscribed credits on a daily basis. We reserve the right to offer multiple Products simultaneously on our Website/Application. Product auctions are open to residents of that specified country.
22.1.4 Where any Product is awarded via an auction, winners will be chosen from all qualifying participations within forty-eight (48) hours of the auction closing date.
22.1.5 If we become aware that the same person has been selected as a winner more than once for the same Product, we reserve the right to select another name if required.
22.2 Decision Making
In the event of any fault, mistake, misunderstanding, or dispute concerning the correctness or acceptability of any response given by a member, or the operation of any part of the Product auction service, networks, or systems, the decision of Unibids L.L.C-FZ shall be final, and no correspondence will be entered into.
22.3 Deficient Bids
In all auctions, we reserve the right at any time to reject any bids that are incorrect, which are otherwise deficient, or not in accordance with the General Terms or Specific Terms. We also reserve the right to reject bids that are unlawful, indecent, racist, inflammatory, defamatory, or which we consider otherwise harmful or offensive in any way. We accept no responsibility for any late, lost, or misdirected bids, including but not limited to texts, calls, or emails not received due to technical disruptions or issues, network congestion, loss in service of online participation mechanisms, computer or technical errors, or any other reason. We cannot enter into correspondence with members who experience difficulties when entering online. Any bids received that are in any way in breach of these General Terms or Specific Terms will be void and will be disqualified from the Product auction.
22.4 Names
Members must participate and bid using their legal name only. We reserve the right to disqualify any member who uses multiple names and to require them to return any Product they may have awarded and received. We also reserve the right to ask any member to produce a form of personal identification in order to verify their identity or any other eligibility requirements as necessary.
22.5 Manipulation of Services
We are committed to operating our auctions fairly and transparently and preventing any abuse of our Products and Services.
For this reason, we reserve the right to disqualify and/or discount auctions if we have reasonable grounds to suspect, in our sole discretion, having regard to all the circumstances and information available at the relevant time, any of the following:
a) activity has occurred that is designed to excessively manipulate the auction; or
b) participations have been made in breach of the General Terms or Specific Terms; or
c) there has been any activity that we consider is designed to unfairly influence the auction and/or provide an unfair advantage to the member including without limitation the use of automated or semi-automated technology, or the making or disguising of multiple credits by an individual member using multiple different phone numbers (or other details on which limits on the number of credits are based), false names, addresses or any other information.
Unless otherwise permitted pursuant to the applicable Specific Terms or unless it is an auction, if we have reason to believe that an individual member of our auctions has made multiple participations using different phone numbers, names, email addresses, or social media pages (or other details on which limits on the number of credits are based) from any one participation platform then we will treat this as an attempt to unfairly influence the auction and all credits submitted by that member will be void.
22.6 Product Limits
The Product is as specified in the Specific Terms (if available).
All Products are subject to availability and to us successfully contacting the winner and confirming eligibility and compliance with both the General Terms and Specific Terms. It may take up to fifteen (15) to twenty-one (21) days to deliver the Product based on availability. The colour of the Product is subject to availability, and the available colour of the same Product will be shipped if the mentioned colour is not available.
22.7 Retrospective Effect
Where a member or winner has been found to be in breach of any of the Terms and Conditions of an auction and in particular where a person is in breach of the auction restrictions, we reserve the right to disqualify that person and require the return or reimbursement to us of any Product even where a Product has been awarded and/or actually provided to the member or the member/winner in question.
23. Auction Products
23.1 We reserve the right (when reasonably required to do so) to replace the stated auction Products with Products that we consider to be of broadly equivalent value. We offer no cash alternative for the auction Products, and the auction winners must accept the Products in the form offered and, where applicable, in accordance with the Terms and Conditions in place from Unibids.me and/or a third-party Product provider. If we notice where an auction Product is awarded to a person younger than 18, we reserve the right not to award the auction Product to the winner or to award the auction Product to the winner’s parent or guardian on behalf of the auction winner.
23.2 All auction winners will be notified that they have been awarded the auction within seven (7) days of the closing date of the auction via at least one of the following methods:
a) by telephone; and/or
b) by email.
23.3 Products will be dispatched to the winners via the local Post or private courier unless otherwise stated. We will not be liable for any Products that are lost, delayed, or damaged in the post for reasons beyond our reasonable control. Further details will be set out in the Specific Terms and/or given to winners when they are notified that they have been awarded the auction.
23.4 Products will only be delivered to an address within the specified country of the Product. Should a Product winner’s contact details change, it is solely their responsibility to notify us about the change in address.
23.5 Products that cannot be shipped via the local Post or private courier must be collected by the winner from the place notified by Unibids™ and/or its third-party Product provider.
23.6 We reserve the right to ask any winner for a form of Personal Identification in order to verify they are who they say they are, be that in the form of a Passport, National ID, Driver’s License, or any other form of Personal Identification. We also reserve the right to ask any winner for some Proof of Address, be that in the form of a Utility Bill, Bank Statement, or any other valid Proof of Address (at our sole discretion).
23.7 In the event that a winner cannot provide us with (i) a valid form of Personal Identification; and/or (ii) valid Proof of Address (both of which are reasonably acceptable to us, judged in our sole discretion), we reserve the right to withdraw the Product and select another eligible member as winner.
23.8 All Products are subject to availability, are non-transferable, and are also non-exchangeable. Where Products consist of entry tickets, air tickets, holidays, and similar time-specific benefits, they must be taken on the dates specified by us (or any relevant third-party provider). Winners will forfeit any element of their Product that they do not take at the time stipulated in the Specific Terms. No cash will be awarded in lieu of that Product or any part of it.
23.9 Unibids™ reserves the right to change the Product or any part of the Product to an alternative of equal or greater value for any reason (in its sole discretion), including without limitation, due to circumstances beyond its control, or if any part of the Product becomes unavailable. If for any reason the winner chooses not to take up the Product or any part of the Product, Unibids™ reserves the right to ask the winner to confirm this in writing and, whether or not such confirmation is received, Unibids™ will be able to retain or dispose of the Product (or part of the Product) at its own discretion.
23.10 Any additional local body or Government tax, levy, duty, or other charges payable as a result of a Product being awarded or received will be the sole responsibility of the winner. Winners should seek independent financial advice prior to accepting a Product if this is of concern.
23.11 We make no representation or warranty in relation to the Products provided, and to the fullest extent permitted by law, we shall have no liability to you in relation to any Product, its fitness for purpose, merchantability, or otherwise.
23.12 We reserve the right to disqualify members from participating in our auction or winners from receiving their Products where any such person engages in unsafe, illegal, unsociable, or inappropriate behaviour.
23.13 If mentioned, all stated Product values are at the supplier's recommended retail price in local currency and are, to the best of our knowledge and belief, correct at the time of printing. We take no responsibility for any fluctuations in Product values. Any other arrangement will be at our discretion.
23.14 No additional, further, or other costs or expenses are included in any Product unless stated. For example, the costs of transport to and from a venue for an event or trip and any accommodation are not included unless otherwise mentioned.
23.15 Third-party suppliers of Products may also often stipulate their own terms, conditions, or restrictions, and all winners agree to be bound by these. Unibids L.L.C-FZ shall have no liability in relation to any Product provided by a third-party provider.
23.16 As far as it is lawful to do so, we exclude our liability for any losses suffered in connection with the auction or any element of the Product.
24. Holiday or Air Ticket Products
24.1 Unless otherwise expressly stated in the Specific Terms, holiday or air ticket Products:
a) and any elements comprising a holiday or air ticket Product including travel and/or accommodation must be taken up during one period, and not on non-consecutive dates.
b) do not include insurance. It will be the responsibility of each winner to take out at their own cost all relevant insurance (including but not limited to health and travel insurance, insurance for theft, loss, and damage to property) that may be required or prudent to obtain.
c) consist of economy class flights (if the holiday is overseas) and accommodation only (on a room-only basis) and do not include visa, airport departure or government taxes (where applicable), spending money, airport transfers, speedy boarding, any additional luggage allowance or any other expenses in relation to recreational activities, food and drink consumption, activities, other travel expenses or otherwise. These must be paid by the winner.
d) must be taken within three (3) months of the closing date or the date set by the third-party provider (whichever is applicable) of the relevant Product, or the Product will lapse with the winner being entitled to no further Product or refund in its absence; and
e) are subject to any Product provider Terms and Conditions in place from time to time, which will apply to the winner as well.
24.2 It is the responsibility of the winner to ensure their ability to travel to their holiday destination and return home, and, in particular, to:
a) ensure that they have a valid passport endorsed with all relevant visas and with an expiry date no less than six (6) months following the proposed dates of travel or such other duration as may be required by any relevant regulation. These passports and their holders must not be subject to any restrictions on their rights to travel to and from the applicable country or countries. Passport control and in-country authorities may reserve the right to refuse entry to winners and/or their traveling companions.
b) check any travel advisories issued by the Government and determine whether they wish to accept the risk of traveling to the holiday destination.
c) obtain any inoculation and comply with any health regulations required by any holiday Product destination country; and
d) comply with the terms and limitations of airlines, other transport providers, and the venues involved in the provision of any holiday Product, including any insurance policy relating to the holiday. In particular, members must comply with all health and safety guidelines and instructions and all applicable legal and regulatory requirements.
24.3 We will not be responsible for any loss or damage suffered by any winner (and/or any Guest that accompanies them) that arises out of their failure to arrive at any holiday destination or return home from any holiday destination, nor will we have any obligation to substitute an alternative Product, cash equivalent or other compensation where a winner (and/or their traveling companion) is unable to travel to any holiday destination or fails to redeem a holiday Product for any reason.
25. Events Products
25.1 Where the Product for any of our auctions involves the winner’s attendance at (or tickets to) an event, the winner acknowledges that we are not liable or responsible if any part of the event is cancelled, varied, or rescheduled for any reason. If this means that the winner (and/or any accompanying Guests) cannot attend the relevant event, we shall be under no obligation to provide any alternative Product, cash equivalent, or alternative tickets.
25.2 If an auction that you participate in involves travel, stunts, or physical challenges, you should notify us of any medical condition that you have, and at our absolute discretion, we may require you as a condition of participating in the auction or receiving the Product to:
a) submit to a medical examination by a medical practitioner approved by us and obtain medical clearance to participate in the auction and/or redeem the Product; and/or
b) execute a legal document to exonerate us from liability in a form prescribed by us in order to participate further in the auction and/or redeem the Product.
25.3 Where Products comprise or include "meet and greet" elements with celebrities, the Product may be subject to the availability of the celebrity in question, and we will have no liability for any inability or failure of any winner to attend any “meet and greet” session offered on any date, nor will we offer any alternative Product or cash alternative or compensation for such failure. We cannot guarantee that the celebrity will fulfil all elements of the Product and accept no liability in this regard.
26. Contact and Claiming Products
26.1 The winner will be contacted as soon as practicable on or after the close date as indicated in the Specific Terms. Reasonable efforts will be made to contact a winner on the contact details provided when bidding on the Product. Unless the Product is time-critical or time-sensitive, all Products must be claimed within twenty-one (21) days of our notification of awarding unless otherwise stated.
26.2 We reserve the right to award Products unclaimed after this period to alternative members or not to award them at all. You must provide us with your correct contact details: otherwise, we may be unable to contact you, and you may as a result forfeit your Product.
26.3 Where the Product must be taken up within 21 days of the close date of the auction, the auction will be considered “time critical”. As a winner needs to be found before the time to take up the Product passes, the Specific Terms will indicate the date(s) when members must be contactable, and Unibids™ will try to contact the winner on the contact details provided.
26.4 If the winner cannot be contacted or successful contact is not made within the time periods set out in clauses above, or as otherwise set out in the Specific Terms (as applicable), or if the winner fails to meet any of the eligibility requirements or is otherwise unable to comply with the General Terms or Specific Terms, this may result in forfeiture of the Product and Unibids™ reserves the right to disqualify that member (without further liability to that member) and offer the Product to the next eligible member and thereafter until a winner is found.
26.5 Any member and/or winner must comply with any directions given to him or her by Unibids™, Product provider(s), and/or their agents and with all relevant laws, rules and regulations, restrictions, and itinerary. Failure to comply with instructions, itineraries, rules, restrictions, requirements, laws, and guidelines may result in invalid participation and/or forfeiture of the Product.
27. Publicity and Personal Information
27.1 Information and data (“personal data”) supplied by members when bidding for the Products will be held by us and may be used by us and, if applicable, our service providers, network operators, and suppliers for the purposes of administering and fulfilling the auctions and in accordance with our Privacy Policy. You should always read our Privacy Policy in addition to these General Terms and the Specific Terms. By bidding for a Product, you agree to this use of your personal data. A member may have their details removed from our database by contacting Unibids™. If details are removed prior to the conclusion of the auction and/or awarding of the Product (s), members will forfeit their right to claim any Products.
27.2 If you are required to submit a third party’s personal data to enter or participate in the auction, you must ensure that the person whose details you submit has given consent for you to provide us with their personal data.
27.3 It is a condition of participation in all our auctions that we have the right to publish and/or broadcast the first name, location, character, likeness, and voices of members and winners.
27.4 In particular, members’ consent to their participation in the auction being communicated to the public on our website/social media pages or otherwise, in our sole discretion.
27.5 Members, particularly winners, may be required to participate in photo, recording, video, and/or filming session(s). You agree that we shall have the right to use all the resulting publicity materials in any media and in any manner we see fit unless you advise us at the time of participating in the auction that you wish to retain your anonymity. You agree that Unibids™ (or any third party nominated by Unibids™) may, in its sole discretion, use the winner’s name and image and their comments relating to the Product and their experience for future promotional, marketing, and publicity purposes in any media worldwide without notice and without any fee being due.
27.6 If you elect for anonymity, we may not be able to include you in certain auctions. This includes providing these materials to our third-party Product providers for the purposes of promoting their association with the auction and awarding the relevant Products. No fees shall be payable to any member in relation to the use of publicity materials.
27.7 Unibids™ and/or a Product provider may send the personal data of members to third parties for the purposes of administering the auction, and by participating, you agree to such transfer for these purposes.
28. Copyright
28.1 By participating in our auctions, all members:
a) assign to us all rights (including present and future copyright) in their participation and their publicity materials in all media (including, without limitation, the internet) and whether in existence now or created in the future.
b) agree not to assert any moral rights in respect of their participation and the publicity materials (wherever and whenever such rights are recognized) against Unibids™, its assigns, licensees, and successors in title.
c) undertake to us that their participation is not in breach of any third-party intellectual property rights and will not contain anything that is defamatory, indecent, harassing, or threatening and that they will indemnify us for any loss, damage, or liability arising should this turn out not to be true. If relevant, we reserve the right, but not the obligation (and without limiting members’ warranty and indemnity as set out above), to screen, filter, and/or monitor information provided by the member and to edit, refuse to distribute, or remove the same.
d) confirm that they have the right, power, and authority to grant the rights set out above and that they have obtained all consents and permissions necessary to grant us the same.
28.2 For the avoidance of doubt, all rights in the name and title of the auction and the format rights for the auction are our sole property, and we may exploit the same at our absolute discretion.
29. Tampering and Other Matters
If for any reason any auction is not capable of executing as planned as a result of any (including but not limited to) technical failures, unauthorized intervention, computer virus, telecom network failure, tampering, fraud, or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of the auction, we reserve the right to cancel, terminate, modify or suspend the credit/s and/or to disqualify any individual who (whether directly or indirectly) causes (or has caused) the problem.
30. Responsibility for Taking Up a Product
Obtaining time off work and/or study or related activities to participate in an auction and/or take a Product will be the sole and absolute responsibility of each contestant. We accept no liability for making alternative arrangements for members to participate or finding alternative arrangements or Products for winners who are unable to take up Products as a result of their own personal circumstances, such as not being available on the necessary dates.
31. Termination of Auction
Unibids™ may vary the terms of, or terminate, an auction at any time at its absolute discretion if reasonably required to do so. Termination or variation of an auction is without liability to any member or other person. Unibids™ will not award the Product if the auction is terminated.
32. Final Decisions
32.1 All our decisions relating to the auction and/or redemption of the Products are final. No discussions or correspondence with members or any other person will be entered into.
32.2 Tiebreakers, disputes, conflicts, questions, or concerns will be managed by us and, if required by law, by an independent adjudicator.
32.3 Where an auction involves voting, the accuracy of the pooled results received and published by us will be deemed to be final and binding, and no correspondence will be entered into.
33. Failure to Enforce Terms and Conditions
A failure by us to enforce any one of the Terms and Conditions in any instance(s) will not give rise to any claim or right of action by any member or winner, nor shall it be deemed to be a waiver of any of our rights in relation to the same.
34. Exclusion of Liability
34.1 Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties, and representations expressed or implied by law are hereby excluded.
34.2 To the fullest extent permitted by law, we hereby exclude and shall not have any liability to any member or winner in connection with or arising out of any auction howsoever caused, including for any costs, expenses, forfeited Products, damages, and other liabilities, provided that nothing herein shall operate so as to limit or exclude our liability for personal injury or death caused by our negligence. For the avoidance of doubt, this paragraph 34.2 shall also apply in respect of any Product provided by a third-party provider.
34.3 In the event that any provision of these General (or any Specific) Terms is held to be illegal, invalid, void, or otherwise unenforceable, it shall be severed from the remaining provisions, which shall continue in full force and effect.
34.4 In relation to all auctions promoted by Unibids L.L.C-FZ:
34.4.1 Nothing in these terms restricts your statutory rights as a consumer.
34.4.2 Nothing in these terms shall exclude or limit our liability for death or personal injury caused by our staff’s negligence or for fraud or for any other liability that cannot be limited or excluded by law or regulation.
34.4.3 Unibids™ cannot guarantee that the Services or Systems for participating in an auction will at all times be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These Services may be suspended temporarily and without notice in the case of any problem with any network or line, system, server, or software, or for any technical malfunction or failure, maintenance, or repair, or for reasons reasonably beyond our control.
34.4.4 Subject to 34.4.1 and 34.4.2, Unibids™ does not accept responsibility where all or any part of the Service relating to an auction is discontinued, modified, or changed in any way.
34.4.5 Subject to 34.4.1 and 34.4.2, Unibids™ does not accept responsibility for any fault, malfunction, damage, loss, or disappointment suffered by you as a member or winner howsoever arising from participating in an auction or from accepting any Product whether due to any error, omission by Unibids™ or its employees, agents or others or by any other cause.
34.4.6 Subject to 34.4.1 and 34.4.2, Unibids™ will not be liable to reimburse the cost or expenses incurred in making an auction participation where applicable.
34.4.7 Subject to 34.4.1 and 34.4.2, Unibids™ does not accept responsibility in the event that any participation is lost, delayed, or not properly received, registered, or for any incorrectly addressed or undelivered auction participation or for any disruption, delay, or misdirection of such participations.
34.4.8 Subject to 34.4.1 and 34.4.2, Unibids™ reserves the right to amend any element of an auction for reasons beyond our reasonable control, including but not limited to the unavailability of the auction participation platform before the closing date, or for a strike, lock-out, labour dispute, illness, an act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. We are not responsible for any loss or damage caused to you as a result of any of these occurrences.
34.4.9 You agree to reimburse Unibids™ in respect of any damages suffered by Unibids™ or any losses by Unibids™ resulting from any claim made by a third party in each case in respect of any matter arising from your use of the Services relating to the auction in breach of the General Terms or Specific Terms or from your violation of any applicable law or regulation.

We are not responsible if the information made available on this site is not accurate, complete, or current.
